25-year-old Avril Nolan originally from Dublin, Ireland and currently living and working in Brooklyn, NY. Is suing Getty for $450,000 for selling her picture to the DHR without her consent!
The Greenpoint resident found out she was the poster child for a Human Rights campaign via Facebook. A quarter page color ad appeared in the widely-distributed free newspaper “amNewYork” back in April featuring Ms. Nolan along side the text “I am positive (+) … I have rights.”
Can you imagine the humiliation and embarrassment? Avril had to face her mortification and explain to family, friends, bosses that her image had been used in an advertisement for HIV services, implying that she was infected with HIV. The picture of the ad with her face on it, was taken years ago by a photographer but according to Jena Cumbo- the New York photographer in question- never intended the picture was used in that way!
You can imagine Nolan’s fury! A simple apology might not be enough, she is also pursuing a legal claim against the state’s Division of Human Rights.
